Terms of Service (ToS)

1. Introduction

Welcome to ReviewRemoval (“the Service”), a product of Cubite Technologies Corp (“we,” “us,” or “our”). By accessing or using this Service, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, you may not use the Service.

2. Purpose of the Service

ReviewRemoval provides AI-powered tools designed to help users analyze Airbnb reviews and assess their eligibility for removal under Airbnb’s content policies.The Service also generates draft messages or contact templates to assist users in communicating with Airbnb.We do not guarantee:

  • That Airbnb will remove or modify any review;
  • That using this Service will result in higher ratings, bookings, or income;
  • That our analysis is error-free or legally binding.The Service is for informational and assistive purposes only and should not be considered legal advice or an official Airbnb dispute submission service.

3. Eligibility

You must be at least 18 years old and have legal authority to manage or represent the Airbnb listing for which you use the Service.

4. User Responsibilities

You agree not to:

  • Misuse the Service or submit false, misleading, or unlawful data;
  • Use the Service to harass, defame, or impersonate others;
  • Attempt to reverse-engineer or disrupt the Service’s AI or systems.You remain fully responsible for any communication you send to Airbnb or third parties, even if generated by our AI tools.

5. Disclaimer of Warranties

The Service is provided “as is” and “as available.”We make no representations or warranties of any kind, express or implied, regarding the operation, accuracy, reliability, or outcome of the Service.We expressly disclaim any warranties of:

  • Merchantability,
  • Fitness for a particular purpose,
  • Non-infringement, or
  • That Airbnb will act upon or agree with the results generated by the Service.

6. Limitation of Liability

To the maximum extent permitted by law, Cubite Technologies Corp and its affiliates shall not be liable for any indirect, incidental, consequential, or punitive damages, including loss of profits, business, or data, arising from your use or inability to use the Service — even if we have been advised of such damages.Your sole remedy for dissatisfaction with the Service is to stop using it.

7. Payment, Refunds, and Chargebacks

  • Payment for the Service is non-refundable regardless of the outcome. We do not guarantee any specific result from using the Service, including removal of Airbnb reviews.
  • You expressly agree NOT to initiate chargebacks or disputes through Stripe or other payment processors. Any such chargebacks will incur a $299 operational fee plus Stripe fees, payable by you.
  • Cubite Technologies Corp reserves the right to contest any disputes and pursue remedies including fee recovery and legal action.

8. Third-Party Contracting and Arbitration

  • If you hire our Service through third-party platforms such as Upwork or similar, you acknowledge that results are not guaranteed.
  • Negative reviews or defamatory remarks about the Service or Company following unsuccessful results may lead to binding arbitration proceedings conducted by the American Arbitration Association (AAA) or JAMS in the United States.
  • You accept liability for damages to Cubite Technologies Corp’s reputation and agree to compensate up to $50,000 USD as determined by arbitration.
  • Arbitration fees and legal costs related to enforcement are also your responsibility.

9. Indemnification

You agree to indemnify, defend, and hold harmless Cubite Technologies Corp and its officers, employees, and affiliates from any claim, demand, or liability (including legal fees) arising out of your use of the Service, your data submissions, or your violation of these Terms.

10. Intellectual Property

All content, designs, code, AI models, and trademarks associated with the Service remain the property of Cubite Technologies Corp. You may not copy, resell, or reproduce any part of the Service without our written permission.

11. Modifications to the Service

We may modify, suspend, or discontinue any aspect of the Service at any time without notice. Updates to these Terms will be reflected with a new “Effective Date.”

12. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Ecuador, without regard to conflict of law principles. Any dispute shall be resolved exclusively in the courts of Quito, Ecuador.
